2011 RULES
MEMBERSHIP AND FEES
1. Membership is signified by payment of $20.00 dues and signing the agreement to follow the market rules.
2. Each member will pay $10.00 per market day and each approved guest will pay $15.00 per market day. Once a member has attended five days, the sixth day is free. There after each day will be $10.00
3. Only paying members will have reserved booth location. Each approved guest requesting to sell for the day will be able to use any left over booths with payment of daily fees.
4. Open to all growers and NOT restricted to citizens of Calloway County (must produce at least 75% of gross sales of products being sold in their booth for the season… refer to products below for more in-depth explanation).
5. Members are responsible for their own taxes and insurance, as applicable.
6. Members must post their name and location of their farm or business at their vending site as well as if produce is grown on that location and signage labeling any produce that is being bought and resold.
SPACE ALLOCATION
1. Membership is accepted as space allows.
2. Vending spaces are 12ft x 12ft. There are 24 spaces available under the pavilion.
3. Each member will have an assigned vending space.
4. Members assigned vending space may be transferred on a per day basis to another vender upon mutual agreement with the Market Manager. Market Manager will have the right to relocate booth assignments for special events as needed.
5. Vending space cannot be subleased.
TIME AND LOCATION
1. The Murray Calloway County Farmers' Market is located at the Calloway County Fair Grounds in Murray, Kentucky.
2. The 2011 market season will open Saturday May 28,2011 and run through Saturday November 5, 2011. Tuesday Market will start Tuesday June 21, 2010. Scheduled market hours:
o Tuesday 3:00pm to 6:00pm - or before if sold out (Starting June 21, 2011)
o Saturday 7:00am to 12:00pm - or before if sold out
3. Vendor setup will begin 30 minutes prior to market opening.
4. Vendors must vacate the market within 30 minutes of closing.
ENFORCEMENT
1. The Market Manager will oversee the market and enforce the rules.
2. Violations of any regulation results in the following penalty:
a. First Offense: verbal warning
b. Second Offense: $50
c. Third Offense: $100
3. In the case of serious or repeat violations, membership may be revoked.
MEETINGS
One meeting will be held in the Spring prior to opening day for organization of the upcoming season and one meeting will be held in the Fall to evaluate the previous year's market and determine changes that need to be made. Special meetings may be called as needed.
PRODUCTS
1. Allowed
a. Agriculture or Horticulture products and Baked Goods
b. Seasonal items: corn stalks, hay, straw
c. Items being sold by organizations promoting agriculture advancement. (i.e. Scholarships for Agriculture Students) Subject to board approval.
d. Artisan products which are handmade. (not limited to but examples are handmade cutting boards, turned bowls, blown glass products, welded products, paintings, sculptures, jewelry, jewelry boxes, pottery, picture frames, photography, hand painted gourd bird house, etc.) Subject to consensus (51%) of vendors present at day of sale. The Market Manager will place a vote in cases of a tie.
e. Other bought or handmade products used to sell produce or products as a package deal. (i.e. bought whicker / ¼ bushel baskets to sell prepackaged allotment of produce or purchased handmade planter stands to sell plants and stand as a package deal or homemade crate to sell "gift" set of jams/jellies)
f. Other value added products. (i.e. someone purchase's excess produce from member "x" and uses commercial kitchen to process and sale as a value added product… i.e. Fresh tomatoes to dried tomatoes or fresh blackberries to cobbler, pie, jelly)
2. Not-Allowed
a. Antiques
b. Carnival and flea market items
c. Coins, Sports Memorabilia and Other Collectable's
3. It is solely the vendor's responsibility to make sure produced goods follow all state and local health and labeling codes. FMMCC is not responsible for policing this, thus it's the vendor's responsibility to work and ensure that all state and local health and labeling codes are being followed. If health inspector comes and vendor is found in violation, then it is their responsibility to correct the issue.
4. At least 75% of gross sales of products being sold in their booth for the season must be produced by the vendor selling the produce. The source of products must be clearly labeled. If a product is being bought and resold, it must be a product that the vendor had planted and had a failure, in-between harvest seasons, or a product that is not currently being sold or planned on being sold at the market by another vendor. Any products being purchased and resold MUST be labeled by signage identifying the product as bought from the seller, other producers, USDA terminals, and/or produce auctions.
5. Vendors selling non-food items must charge sales tax unless they have signs displayed stating "Sales Tax Included". The market must be supplied with sales tax number form from vendor, if applicable.
6. Pricing must be above wholesale terminal prices for that week. Copies of the wholesale terminal prices are available from the USDA. No dumping tolerated.
7. Prices should be displayed for all produce where customers can clearly read them.
APPEARANCE AND CONDUCT
1. Members will be neat, suitably dressed, and deal with the public in a courteous and appropriate manner.
2. All members will display their products neatly and attractively, with consideration for the other members and the general public.
3. Members are responsible for their own stalls, will supply all necessary trash containers and will leave their site clean and in a condition acceptable to the market manager and property owner. This includes the removal of trash containers and other waste and trimmings before leaving the market. All vendors will work with Market Manager to ensure property is left clean.
4. Farmers' Market of Murray - Calloway County prohibits members from bringing live animals to the market site unless required by law or with permission of the Market Manager.
5. Loudspeakers or bullhorns are not permitted.
6. Smoking by vendors will not be permitted except in designated smoking areas.b
7. Alcohol beverages may not be sold, consumed, or advertised.
8. Only signs promoting products being sold are allowed. No political campaign signs or campaigning at the market will be allowed.
INSURANCE
All Vendors of the market are strongly encouraged to purchase insurance. Certificates of insurance must be presented to Market Management. All vendors will comply with KRS Regulations.
RIGHT OF REFUSAL
The Farmers' Market of Murray - Calloway County reserves the right to refuse membership to anyone.
HOLD HARMLESS STATEMENT
Market Members and Guest Vendors agree to release and hold harmless Farmers' Market of Murray - Calloway County, Inc. and Murray-Calloway County Fair Board and their employees, agents and volunteers from and against all liability, loss damages, claims, costs, and expenses (including attorney fees) arising out of injury to person or damages to property or any other injury, claim, damage, loss, cost or expense arising from any activity on the premises.
MEMBERSHIP AGREEMENT
I Acknowledge that I have read and understand the above state rules, for the Farmers' Market of Murray Calloway County, and that I agree to abide by all rules adopted by the market management. I further acknowledge that I have received a duplicate copy of the rules.
